1. DEFINITIONS AND INTERPRETATION

1.1 Settlor: The individual or entity that creates the trust and transfers property into it. The Settlor is also referred to as the Trustor.

1.2 Trustee(s): The individual(s) or institution responsible for managing the trust property as per the terms of the trust.

1.3 Beneficiary(ies): The individual(s) or entities who will benefit from the trust.

1.4 Trust Property: All assets, including cash, real estate, investments, and any other property transferred to the trust by the Settlor.

1.5 Trustee’s Discretion: The discretion granted to the Trustee(s) to act in the best interest of the Trust, making decisions regarding the use and distribution of Trust Property.

1.6 Trust Fund: The total assets, including income, held within the Trust.


2. CREATION OF THE TRUST

2.1 Establishment of Trust:

2.2 Declaration of Trust:

2.3 Transfer of Property:
The Settlor has transferred to the Trustee(s) the property listed in Schedule A (attached). Any future property transferred into the Trust shall be subject to the terms of this Trust Deed.


3. OBJECTIVES OF THE TRUST

4. TRUST PROPERTY

4.1 Initial Trust Property:

5. POWERS OF THE TRUSTEE(S)

  • Investment Powers: The Trustee(s) shall have the power to invest and reinvest the Trust Property in real estate, securities, or other investments, as deemed appropriate by the Trustee(s).
  • Management of Property: The Trustee(s) may manage, maintain, and operate any real estate or other property in the Trust, including leasing or renting the property.
  • Sale or Disposition of Property: The Trustee(s) have the authority to sell, mortgage, or exchange any part of the Trust Property, as they see fit, for the benefit of the Trust.
  • Income Distribution: The Trustee(s) may distribute the income generated from the Trust Property to the Beneficiaries at such times and in such amounts as they deem appropriate.
  • Borrowing Powers: The Trustee(s) may borrow money in the name of the Trust for the purposes of administering the Trust, including for investment or other trust-related expenses.

5.2 Discretionary Powers:
The Trustee(s) have the discretion to determine the amount, timing, and manner of any distribution of income or principal to the Beneficiaries.

5.3 Co-Trustees:
If there are multiple Trustees, they shall act jointly unless otherwise agreed upon in writing. In the event of the incapacity, resignation, or death of any Trustee, the remaining Trustee(s) shall have the authority to appoint a successor.


6. DUTIES OF THE TRUSTEE(S)

6.1 Fiduciary Duty:
The Trustee(s) shall act solely in the best interests of the Trust and the Beneficiaries, adhering to the principle of fiduciary duty. This includes avoiding conflicts of interest and acting with care, diligence, and loyalty.

6.2 Duty to Maintain Records:
The Trustee(s) shall maintain accurate records of the Trust Property, income, and all transactions related to the Trust. They shall provide regular statements and accounting to the Settlor (if living) and the Beneficiaries.

6.3 Duty to Act in Accordance with the Terms of the Trust:
The Trustee(s) shall act in strict accordance with the terms and conditions laid out in this Trust Deed.

6.4 Duty to Provide Information:
The Trustee(s) shall provide the Beneficiaries with reasonable access to information concerning the administration of the Trust.


7. BENEFICIARIES

7.1 Initial Beneficiaries:
The initial Beneficiaries of this Trust are identified in Schedule B attached to this Deed.

7.2 Additional Beneficiaries:
The Settlor may, from time to time, designate additional Beneficiaries, with the written consent of the Trustee(s).

7.3 Rights of Beneficiaries:
The Beneficiaries shall have the right to receive income or principal from the Trust in accordance with the terms of this Deed, at the discretion of the Trustee(s).

7.4 Classes of Beneficiaries:
The Settlor may specify different classes of Beneficiaries, including primary and contingent Beneficiaries, and the terms of distribution to each class.


8. DISTRIBUTIONS FROM THE TRUST

8.1 Income Distribution:
The Trustee(s) shall distribute the income generated from the Trust Property to the Beneficiaries at such times and in such amounts as determined by the Trustee(s), subject to the purpose of the Trust.

8.2 Principal Distribution:
The Trustee(s) may distribute all or part of the principal of the Trust Property to the Beneficiaries, at their discretion, in accordance with the terms of this Deed.

8.3 Termination of Trust:

9. DURATION AND TERMINATION OF THE TRUST
